Under the Social Security Law, there are potentially substantial penalties for entry of fictitious MDS data, and one could make a case that often some of the data present in the MDS is not based on clinical evidence but is just filled in with a default response. If the CMS insisted on clinical evidence to back up the comprehensive MDS data, we would probably see an industry much more interested in providing quality care. There is a pervasive view among individuals who work in this industry that it is mostly about waiting for the residents to pass on.
